Restructuring Advisor Services

Through Oriole Advisors Ltd., Mr. McElcheran offers restructuring advisory services as a court officer or private appointment as an advisor to the business or board.

In the role as a restructuring advisor, Mr. McElcheran assists the board and/or management in devising a strategy for restructuring the business and building consensus among stakeholders of the business.

Mr. Justice Brown of the Ontario Superior Court commented in De Groote v. DC Entertainment Corporation, 2014 ONSC 3769:

The plaintiff proposes that Kevin McElcheran act as the CRA, through his company Oriole. Of Mr. McElcheran’s qualifications to perform the proposed duties of the CRA, I have absolutely no doubt. Mr. McElcheran is a highly skilled and experienced insolvency practitioner who is qualified for the position.

Through Oriole Advisors, Mr. McElcheran has taken interim executive roles with businesses facing business challenges. For more than 2 years, he was Interim Managing Director of a national chain of Thrift Stores. The business employed nearly 3000 people in 9 provinces and experienced 25% growth in sales during Mr. McElcheran’s term. The business continues its important mission under permanent management recruited with Mr. McElcheran’s assistance.

Mr. McElcheran has also taken appointments as director to provide guidance in the restructuring process. In the case of Firstonsite, he joined the board and restructuring committee while the business was offered for sale. The company filed for CCAA protection to complete the sale with the benefit of Mr. McElcheran’s evidence of the pre-filing process completed by the company. Finally, after the sale closed, Mr. McElcheran was appointed CRO to settle post-closing adjustments and facilitate the distribution of sale proceeds.

Mr. McElcheran performed a similar role as an advisor to a oil field service business that was offered for sale in early 2020 working with the board of the company, its lenders the lenders’ consultants and investment advisors hired to conduct the sale.

Mr. McElcheran is currently a board member of a former sports equipment company overseeing litigation against the former board of directors and officers.
